By using Helena(ASE/ASA) ("We", "Us", "Our", or the "Service"), you agree to be bound by the following Terms of Service. These Terms apply to all users globally and are compliant with the applicable laws of the United Kingdom, United States, and international standards. If you do not agree with these Terms, do not use the Service. 

Affiliation Disclaimer 
Helena is not affiliated, associated, authorized, endorsed by, or in any way officially connected with Nitrado, Discord, or Wildcard. All trademarks and intellectual property belong to their respective owners. 

Eligibility & Discord Terms 
You must comply with Discord’s Terms of Service and be above the minimum age requirement to use the Service. Use of the Service in violation of Discord's policies is prohibited. 

Service Access & Usage 
Use of the Service is at your own risk. The Service is provided on an "as is" and "as available" basis. We do not warrant that: 

1. The Service will meet your specific requirements; 

2. The Service will be uninterrupted, timely, secure, or error-free; 

3. The results obtained from using the Service will be accurate or reliable. 

We reserve the right to suspend or terminate your access to the Service, temporarily or permanently, with or without notice, for any reason including misuse or abuse. You may not duplicate, copy, or reuse any portion of the Service code or concepts without express written permission. 

Limitation of Liability
If you authorize a Nitrado token for use with Helena, any individual with access to that token may retrieve or interact with your Nitrado-related data via the Service. 

Helena does not accept responsibility for any unauthorized data access caused by third parties to whom you have granted Nitrado access. You are responsible for managing access to your Nitrado account and any tokens it can generate. 

Sharing your Nitrado account or credentials with others introduces the risk of exposing sensitive data, and we strongly discourage such sharing unless absolutely necessary. 

Recurring Payments & Subscriptions 
By subscribing to Helena, you agree to a recurring billing arrangement. Charges are processed automatically (monthly or annually, based on your plan) and may include applicable taxes, transaction fees, and other service-related costs. 

It is your responsibility to cancel your subscription before the next billing cycle. Failure to do so will result in continued charges. No refunds are provided for unused subscription time, except as required by law or at our sole discretion. Cancellations can be made via Stripe’s Account Management page or our Support Server.

We may, at our discretion, offer limited-time promotions or discounts subject to eligibility criteria. Participation in past offers does not guarantee future discounts. 

Refunds are generally not issued for unused time if a subscription is cancelled early. Any refunds or credits are granted solely at our discretion and in accordance with applicable consumer protection laws. 

We may offer promotions or discounts at our sole discretion. These offers are subject to eligibility criteria and are valid for a limited time. Participation in past offers does not entitle users to future discounts. 

Right to Cancel (UK & EU Residents) 
If you are a consumer based in the UK or EU, you have the right to cancel your initial subscription within 14 days of purchase. However, by beginning to use the Service immediately, you agree to waive this right to cancel. 

Privacy and Data Protection 
Your personal data is processed in accordance with our Privacy Policy, which complies with the UK GDPR, EU GDPR, and applicable US data privacy laws. By using the Service, you agree to our data handling practices. 

Limitation of Liability 
We are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from: 

• The use or inability to use the Service 

• Unauthorized access or changes to your data 

• Any third-party conduct or content 

Modifications to Terms 
We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting. Continued use of the Service after changes constitutes your acceptance. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription. 

Governing Law & Jurisdiction 
These Terms are governed by the laws of the United Kingdom and the United States. However, if you reside in a jurisdiction that grants you mandatory consumer rights or data protection under local laws, those rights will apply to the extent required by law. Any disputes shall be resolved in accordance with the governing law, unless local laws require otherwise. 

Local Law Compliance 
Nothing in these Terms shall exclude any rights you are entitled to under applicable local consumer protection laws in your country of residence.
